Hello all
Just wonder if someone could shed some light on my problem based on your knowledge and experience:
I am planning to get married in April 2008. I am french and my would-be is indian. My would-be doesnt have a birth certificate since her birth. For special marriage the indian authorities accept the university Transfer certificate for evidence of date of birth. Whereas the french consulate have asked for the birth certificate of my would-be as well as the marriage certificate of her parents to issue the french marriage certificate.
Is there anyone out there who is aware of any procedure as how to avoid going to the court to apply for a birth certificate (which is really tedious and time consuming) to get the french mariage certificate. I heard someone talking about providing the consulate with an "affidavit" instead of a birthcertificate. Does anyone have any experience doing this?

Hi Jay
She can contact the local municipality office (equivalent to mairie here) in her hometown with an application and her HSLC (as a proof of her date of birth), and normally they will give her a birth certificate. You might not need going to the court. In you place I would probably do this, as birth certificate is a very essential paper and we need it through out our life.

Hi Jay,
Great ! you are planning in nov for u marriage in april ...
Well if ur would be is in france, you can go to indian embassy with her passport and they can give u a birth certificate.
If ur would be is in india, u can do as saurav suggested
or
if i am not wrong u can prepare one affidebit on 20indian rupees stamp paper with ur birth date declaration. Then get it certified by a notary and then get it translated through any alliance francais office in india. I never get it done in practical for me but heard that it is ok as per french procedure. For your information, all these processes are not complicated and can be done within same day in india.

I agree with saurav that a birth certificate is an important piece of document that may be needed anytime in the future. Apparently they used to issue birth certificates like you said Saurav but was told by the officials in Chennai that they dont do that anymore due to the fear of terrorist fraudsters and was told that all these applications must go through the indian court system.
I have sent an email explaining my situation to the french consulate in pondichery (the jurisdiction of the marriage) regarding this asking if they can give their advice. Hoping to get a reply suggesting something similar (affidavit) to what Ashwani has said. it would make my life easier.
inspite of all i still would prefer to have a birth certificate issued to my finacee somehow. I hope i will get it.
